Introduction
These Terms of Service (“Terms”) govern access to and use of the EssayGuard writing platform and academic integrity tools (“Service”).
By accessing or using the Service, educational institutions, instructors, and students agree to comply with these Terms. If you do not agree with these Terms, you may not use the Service.
1. Description of the Service
EssayGuard provides a browser-based writing environment that allows students to compose assignments and allows instructors and institutions to review the writing process.
The platform may record writing activity within the assignment editor, including typing patterns, timestamps, and pasted content, in order to support academic integrity review.
2. Institutional Use
When the Service is used through a school, college, or university, the institution is the primary customer and controls the use of the Service.
Student users access the platform at the direction of their institution, and the institution controls the associated education records in accordance with applicable laws including FERPA.
3. Acceptable Use
Users agree not to:
- use the Service for unlawful purposes
- attempt to gain unauthorized access to the platform
- disrupt or interfere with system security or functionality
- attempt to reverse engineer or copy the platform technology
Institutions and instructors are responsible for ensuring that the Service is used only for legitimate educational purposes.
4. Academic Integrity Tools
The Service may provide tools designed to assist instructors in reviewing the writing process and identifying potential academic integrity concerns.
These tools are intended to provide information and indicators only. Final academic decisions remain the responsibility of the instructor or institution.
5. Privacy and Data Use
Use of the Service is subject to the EssayGuard Privacy Policy.
When the platform is used by an educational institution, EssayGuard processes student information on behalf of the institution and acts as a service provider under the institution's direction.
6. Intellectual Property
All software, technology, and materials comprising the Service are the property of EssayGuard or its licensors and are protected by intellectual property laws.
Users are granted a limited, non-exclusive license to access and use the Service solely for educational purposes authorized by their institution.
7. Service Availability
EssayGuard strives to maintain reliable access to the platform but does not guarantee uninterrupted availability.
The Service may be updated, modified, or temporarily unavailable due to maintenance, security improvements, or technical issues.
8. Limitation of Liability
To the fullest extent permitted by law, EssayGuard shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the Service.
Academic decisions based on platform data remain the responsibility of the educational institution or instructor.
9. Termination
Access to the Service may be suspended or terminated if users violate these Terms or if the institution terminates its agreement with EssayGuard.
10. Changes to Terms
EssayGuard may update these Terms periodically. Updated Terms will be posted within the platform or provided to institutional customers.
Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.
